Commissions Terms of Service

AGREEMENT OVERVIEW
^{By commissioning artwork from the Artist, the Client agrees to the following Terms of Service. These terms become legally binding once payment has been submitted.}^{The Artist agrees to create original illustration artwork based on the Client’s provided brief. The Client agrees to provide clear communication, accurate references, and timely responses throughout the commission process.}^{The Artist reserves the right to refuse any commission request for any reason.}SCOPE OF WORK
^{The commission includes one custom illustration as described in the agreed brief.}

^{Type: Flat Color (Default) / Lineart / Rendered}
^{Background: Flat Color / Flat Color & Pattern / Environmental BG}
^{Canvas Size: Square: 3000 x 3000 pixels / 4:5/Typical Instagram Post Ratio: 2160 x 2700 pixels / HD/Typical Video Ratio: 3840 x 2160 pixels. The Client is also allowed to leave the canvas size up to the Artist's discretion if desired, for no additional fee.}

^{Inquiry and Approval}
^{The Client must provide a detailed description of the subject, clear visual references if applicable, and the intended usage (personal or commercial).}
^{The Artist will provide a price quote, estimated timeline, and payment instructions.}
^{Work will begin only after payment requirements are met.}^{Workflow Stages}
^{Stage 1: Sketch Phase}
^{A rough sketch will be sent for approval. Minor revisions are allowed at this stage.}
^{Stage 2: Clean Lineart or Base Colors}
^{A refined version of the approved sketch will be created. Only small adjustments are allowed.}
^{Stage 3: Rendering and Finalization}
^{Coloring, shading, and detailing, if applicable will be completed. No major changes are allowed at this stage.}
^{Progress updates will be provided at major checkpoints.}PAYMENT TERMS

^{Payment Method: Zelle, Discord, PayPal, Ko-fi}
^{A non-refundable 50% deposit is required upfront. The remaining balance must be paid before the final high-resolution file is delivered.
Invoices must be paid within 5-7 days of confirmation of the order from the Artist. Failure to pay may result in cancellation of the commission.}
^{The Client is responsible for transaction fees unless otherwise agreed.}TURNAROUND TIME
^{Estimated completion time is 4-6 weeks, unless otherwise specified.}
^{Turnaround may vary depending on complexity, current queue, and Client responsiveness.}
^{Delays caused by the Client may extend delivery time.}
^{Rush orders may incur additional fees.}REVISIONS POLICY
^{Up to 2 minor revisions are included during the sketch phase.
Minor revisions include small pose adjustments, expression changes, and minor detail corrections.}
^{Major composition changes after sketch approval or large redraws after rendering has begun are not included and may require additional fees.}CLIENT RIGHTS (PERSONAL USE LICENSE)
^{Unless otherwise agreed in writing, the Client receives a non-exclusive personal use license.}
^{The Client may share the artwork online with proper credit, print it for personal use, and use it as a profile picture, banner, or wallpaper.}
^{The Client may not claim the artwork as their own, remove the signature or watermark, resell or redistribute the artwork, mint it as an NFT, use it to train AI under any circumstances, use it for blockchain purposes, or use it commercially without purchasing a commercial license.}COMMERCIAL LICENSING
^{Commercial use requires prior written agreement and an additional licensing fee, typically ranging from 50 to 200% of the base price depending on usage.}
^{Commercial use includes but is not limited to merchandise, advertising, branding or logos, book covers, monetized streaming overlays, game assets, and promotional materials.}
^{The Artist retains copyright unless explicitly transferred through a signed contract.}COPYRIGHT AND ARTIST RIGHTS
^{The Artist retains full copyright ownership of all commissioned artwork.}
^{The Artist may display the artwork in their portfolio, post it on social media, use it for self-promotion, and include it in prints or art books.}
^{If the Client requests privacy, this must be discussed before work begins and may incur an additional fee.}
^{The Artist reserves the right to cancel any commissions not in alignment with what they will draw, which includes NSFW content, anthropomorphic characters, mechanical characters, and heavy gore.}CANCELLATIONS AND REFUNDS
^{If the Client cancels before work begins, a full refund will be issued.}
^{If cancellation occurs after the sketch phase, the refund will exclude the deposit.}
^{If cancellation occurs after rendering has begun, no refund will be issued.}
^{If the Artist cancels due to unforeseen circumstances, a full refund will be issued for unfinished work.}AI AND DATA USAGE PROTECTION
^{The Client may not use the artwork for AI training datasets, upload the artwork to AI image generators, use it for machine learning systems, or tokenize or scrape it for automated systems.}
^{The Artist does not consent to their work being used for AI training or artificial intelligence development.}CLIENT CONDUCT
^{The Artist reserves the right to cancel a commission without refund if the Client engages in harassment, hate speech, discriminatory behavior, threats, or fraudulent chargebacks.}
^{Professional and respectful communication is required at all times.}FILE DELIVERY
^{Final files will be delivered via email or secure download link in a PNG and JPG format.}
^{Layered source files such as PSD or Procreate files are not included unless purchased separately.}
^{The Artist is not responsible for printing errors from third-party services.}LIABILITY LIMITATION
^{The Artist’s liability is limited to the amount paid for the commission.}
^{The Artist is not responsible for unauthorized third-party use, misuse of the artwork, or copyright disputes caused by Client misuse.}ACCEPTANCE OF TERMS
^{By submitting payment, the Client confirms that they have read and agreed to these Terms of Service, understand usage restrictions, are 18 years or older or have guardian permission, and will not issue fraudulent chargebacks.}
